1. Applicability
1.1. These Terms and Conditions apply to every offer from Blix and to every distance contract concluded between Blix and a consumer or business customer through our webshop or otherwise.
1.2. Deviations or additions are only valid if confirmed in writing by Blix.
1.3. If (part of) these terms and conditions are void or annulled, the remaining provisions will remain in full force. Blix will replace the void part with a valid provision that is as similar as possible.
2. Account & use of the services
2.1. Certain features may require an account. You are responsible for entering your login details correctly and completely, and for keeping them secure.
2.2. Minors require parental/guardian permission.
2.3. It is not permitted to transfer or sell accounts.
3. Offer, product information and availability
3.1. We take great care to ensure product information is accurate and up-to-date. Images are for illustrative purposes only; colors and appearance may vary due to screen settings.
3.2. The offer is without obligation and may be changed or terminated at any time.
3.3. Obvious errors or mistakes (e.g. pricing or typographical errors) do not bind Blix.
4. Conclusion of the agreement
4.1. Your order constitutes an offer to purchase. The agreement is concluded after Blix expressly accepts the order (order confirmation) and payment has been processed.
4.2. Blix may refuse orders or impose conditions on their execution (e.g., limited quantities, anti-resale).
5. Prices, taxes and payment
5.1. Unless otherwise stated, prices in the webshop include VAT and exclude shipping/handling and any customs charges. The total price is shown at checkout.
5.2. Promotions and discounts are not cumulative and may change without prior notice.
5.3. Payment is made using the payment methods offered in the webshop. You guarantee that you are authorized to use the chosen payment method.
6. Shipping costs, delivery and transfer of risk
6.1. Delivery times stated are indicative. Exceeding these times does not entitle you to compensation or termination, unless mandatory law provides otherwise.
6.2. Delivery will take place at the address you specified.
6.3. Transfer of Risk: For consumers, the risk passes upon actual delivery to you. For business customers, the risk passes upon delivery to the carrier.
7. Right of withdrawal (consumers only)
7.1. You have the right to cancel your online purchase within 30 days of receipt without giving any reason .
7.2. Report the revocation within the period via info@blixtoys.eu
7.3. After cancellation, you have 30 days to return the product(s) unused, undamaged and – to the extent reasonably possible – in the original packaging.
7.4. Return shipping costs are for the consumer, unless otherwise stated.
7.5. Blix will refund the purchase price (including standard outbound shipping costs) within 30 days of cancellation, but may withhold reimbursement until receipt or delivery of proof of shipment.
7.6. Exclusions (to the extent permitted by law):

sealed products which are not suitable for return for reasons of health protection or hygiene and were broken after delivery;

custom-made or clearly personalized items;

digital content which is not supplied on a tangible medium, if commenced with your express consent before the end of the cooling-off period.
8. Returns & Warranty
8.1. See our Returns Policy page for practical return instructions.
8.2. Legal Compliance: As a consumer, you are entitled to a proper product. In the event of a defect not caused by you, we will provide free repair, replacement, or—if not possible or reasonable—refund in accordance with the law.
8.3. For business customers, Blix will repair, replace, or credit the product at its discretion, provided the defect is reported in writing within 30 days of discovery and the product has been used correctly.
9. Use in education & safety
9.1. Our STEM sets are educational products. Use under adult supervision when appropriate and follow the instructions and safety guidelines.
9.2. Blix supplies products with CE marking and compliance with relevant standards (including EN 71-1/2/3). Documentation (DoC/test reports) is available upon request.
10. Intellectual property
10.1. All (brand) names, designs, texts, photos, videos, manuals, and other content on our website and in our materials are protected and belong to Blix or its licensors.
10.2. It is not permitted to copy, publish, reproduce, or otherwise use material without prior written permission.
11. Third-party tools and services
11.1. We may offer third-party tools or services (e.g., payment providers). Their use is subject to the terms and conditions and privacy policy of that third party.
11.2. We provide this "as is" and are not liable for the actions or omissions of third parties.
12. External links
12.1. Links to third-party websites are provided solely for convenience. Blix is not responsible for the content, privacy policies, or practices of these sites.
13. Relationship with Shopify
13.1. Our webshop is hosted by Shopify . However, purchases are made directly with Blix . Shopify is not a party to your purchase agreement with Blix and is not responsible for our sales, products, or services.
14. Reviews/Feedback
14.1. By posting feedback/reviews, you grant Blix a non-exclusive, worldwide, royalty-free license to use and publish them in connection with our services and marketing, subject to applicable law.
14.2. You warrant that your feedback does not violate any third-party rights, is not unlawful, and does not contain malware. We may reject or remove any feedback that violates these terms.
15. Errors and changes
15.1. Information, prices, and availability may contain typographical or display errors. We reserve the right to correct these and cancel orders in the event of obvious errors.
15.2. We may update or change our website, product range, and terms and conditions.
16. Prohibited use
16.1. It is prohibited to use the website for unlawful purposes, to circumvent security measures, to scrape/spam data, to violate the rights of third parties, or to disrupt the operation of the site.
16.2. In case of misuse, Blix may block accounts and/or take legal action.
17. Liability
17.1. Blix is not liable for indirect damage, consequential damage, or lost profits.
17.2. For consumers, statutory rights regarding product safety and conformity always take precedence.
17.3. For business customers, Blix's total liability is limited to the invoice amount of the relevant order, unless there is intent or deliberate recklessness.
18. Indemnification (B2B)
18.1. The business customer indemnifies Blix against claims from third parties related to the (continued) use of the delivered products, insofar as the cause is attributable to the customer.
19. Force Majeure
19.1. Blix is not obligated to perform in the event of force majeure (including natural disasters, war, strikes, pandemics, disruptions at third parties/carriers, and government measures). Obligations are suspended for the duration of the force majeure.
20. Duration and termination
20.1. We may (temporarily) restrict or terminate access to the website/services in the event of misuse or security risks. This does not affect payment obligations.
21. Privacy
21.1. Our Privacy Statement applies to the processing of personal data (see link in the footer).
21.2. For disputes, you can also use the EU ODR platform for online dispute resolution: https://ec.europa.eu/consumers/odr/
22. Applicable law and competent court
22.1. These terms and conditions and agreements are governed by Dutch law .
22.2. Disputes will be submitted to the competent court in Rotterdam , unless mandatory law prescribes otherwise.
23. Changes to the terms and conditions
23.1. The most recent version is always available on our website. We will inform you of any material changes in accordance with applicable law. Continued access or use after the amended terms and conditions take effect constitutes acceptance of the amended terms.
